According to American Express, In order to be valid, Subpoenas must:

  • Indicate the court/jurisdiction and include the case number and case style or have an Agency Letterhead
  • Be issued to the correct American Express Entity
  • Be signed and dated
  • Provide either:
    • Customer’s full SSN/EIN or
    • Customer’s full Account Number or
    • Customer’s full Name AND last 4 digits of SSN/EIN or
    • Customer’s full Name AND last 5 digits of Account Number

Subpoenas should also clearly identify the documents and/or records requested. Any subpoenas received with vague requests (i.e. “any and all”) may result in limited responses. Additionally, if a time period is not specified, then we will provide the last 6 months of available records from the date we receive the Subpoena.

Motions to Quash or Objections must be received prior to the date on which American Express must legally comply with the subpoena in order to prevent the release of records. In such instances, the compiled records will be retained and released only upon court order, joint stipulation of the parties or with the customer’s written authorization. We also reserve the right to request supporting documentation to determine how the records sought are relevant to the pending litigation or proceeding.

    I need to know whom to contact in reference to racial issues at American Express contracted site with numerous issue especaily involving black people.I am trying to contact them before filing Fedreal law suite or going public about it.I am hoping they maybe able resolve it before I have to proceed legally.

Subpoena compliance departments do not handle these types of issues. Moreover, you cannot contact these companies by posting comments on this website.

    Dear Site Administrator: I just noticed your disclaimer above and wish to tell you that I have in my possession a return receipt from the Post Office which delivered my CERTIFIED, RETURN RECEIPT letter to American Express to “DATAMARK, INC, 43 BUTTERFIELD CIRCLE, EL PASO, TEXAS 799936” DATAMARK then sent me a letter which had “American Express” at the top and a signature of an American Express executive at the bottom. What do you consider is required for for representation of being American Express? John Carter

    • Dear Readers,

      Most of you understand this, but a few just don’t. This website is just a directory, like the phone book. Getting mad at the phone book company because you called someone listed in the book, and they were mean to you, makes no sense. We list addresses and phone numbers, and we try to get it right, and usually do. That STILL doesn’t mean that WE are the company listed, anymore than the Yellow Pages IS Pizza Hut, or your Aunt Betty, or anyone else for that matter. It’s a gosh darn glorified address book ya got here, only we specialize in providing addresses and phone numbers for legal departments at big companies, and those departments process SUBPOENAS. They aren’t bill collectors, and you shouldn’t be calling them unless you are an attorney, or you work for an attorney, and have a question about a SUBPOENA. If you can’t understand that, or don’t believe that, ask ANYONE who works in a law firm, and they can explain this to you using small, monosyllabic words. Geez, try to help people out and all the trolls come out from under the bridge.

      Before you accuse us of all manner of evil doing, at least Google the term “subpoena compliance” and educate yourself before you engage in libelous activity, which is, by the way, illegal in all 50 states. And THAT is a fact.

    DATAMARK APPEARS TO HAVE BEEN HIRED BY AMERICAN EXPRESS TO PROCESS PAYMENTS MADE BY HOLDERS OF ONE OR MORE OF ITS CREDIT CARDS. IT APPEARS TO ALSO PROCESS PAYMENTS FOR BARCLAY’S BANK CREDIT CARDS. IT CASHED MY CHECK MADE PAYABLE TO “AMERICAN EXPRESS” WHICH INADVERTANTLY HAD A BARCLAY’S BANK ACCOUNT NUMBER AND SENT THE FUNDS TO BARCLAYS (WHERE THE ACCOUNT HAD A ZERO DUE BALANCE) AND CAUSED ALMOST $100.00 IN VARIOUS FEES TO BE ADDED TO THE AMERICAN EXPRESS ACCOUNT. I AM UNABLE TO GET ANY SATISFACTION OR EVEN REASONABLE COMMUNICATION FROM THEM, NOT TO MENTION ANY ACTION.
